Default Can I sue in small claims court if the person I am suing is in another state?

We want to sue a guy (his business) who is in California, we are in Texas. Not only have we paid him $5,660 to work on our motor, but we shipped him the motor itself. Now PayPal wont let us claim the first $3,00 because it has been over 45 days. The remainder of the money is the only thing we can dispute through paypal. We need to get our motor back (he never shipped it and its been almost 4 months) and the rest of the money. Can we sue in small claims court even if he is in another state or should we hire an attorney?The guy never answered his phone and never responded to emails. He got upset when he found out about paypal dispute and stopped shippment of my motor. Now he blames his chemotherapy for not doing his job, dosent he have other employees???

You can sue someone in another state, but it'll be very difficult compelling that person to appear in court. Your best bet is to check your local Yellow Pages for attorneys who give free initial consulations. They'll be able to tell you whether you have a case and whether it's worth pursuing.

contact the local Better Business Bureau in his area. Depending on the state "small claims" means a financial amount not to exceed a certain number of dollars. That really stinks for both you and the business guy.

you may have to sue in the state the guy lives but for that monies it maybe well worth it to file, you can file the paper from Texas just have to appear on the court datemost small claims do not have what is called a long arm statute which allows under certain circumstances a court in one state to serve a person in another state notice of court hearing
