Default My employer is cheating me here in Australia, can you help me with my options?

My employer has led me to believe that I am paying taxes and superannuation weekly when in fact he is pocketing the money for himself. Without any taxes or super ever being paid it is very easy for my employer to destroy any evidence of me working for him. If I contact the Australian Taxation Office will I be able to get my employer fined if I have a few witnesses?I am getting paid in cash, my employer led me to believe I could illegally get paid in cash while still paying taxes.

yes for impersonating the tax office, and yes if you have witnesses.but don't let him know your going to call =/!how are you being paid?if by cash then theres no such thing as a tax to that.

You should ask for assistance from the Australian Taxation Office to preserve your right as a worker and as a tax payer. If you dont, you will also be the one who's going to be in trouble if the found out that your not paying your taxes at all even if is your employers fault. Fight for your right man. Just do what is right.

Most mp3 players have a record button on them, and have a built in micraphone. You can buy one for pretty cheap, about twenty American dollars. If you don't put any songs on it you will have about three to four hours of record time on it. Just go to the bathroom at work, and put in on record. Then when you come out, You can ask him about his suspecious activities in an open and trusting way. He will probably think you are nieve for asking such a stupid question, and tell you bluntly that if you do something stupid, you will get in trouble. Then you will his lie recorded, and you can use that evidence to take to the Austrilian Tax office.Hope that helped,Jer

If you filled out a proper ATO employment declaration form and provided your tax file number, he is clearly in the wrong. You should be entitled to PAYG withholding tax credits on your gross (pre tax) income even if he doesn't actually pay it to the ATO. If he has been withholding money for tax from your wages, then this is now between him and the ATO and you are not going to be held in the wrong. You are entitled to claim those tax credits even if he tries to rip off the ATO.You need to call the ATO and tell them about this as soon possible. You should also work out your total gross pre-tax wages and tax withheld amounts for this tax year to date. Because you're not going to get a PAYG payment summary (group certificate) at the end of the year and will have to do a statutory declaration to claim the tax credits in your tax return.You have to do this or you will still have to declare the income you have received in your tax return but you won't have any tax credits and will owe the ATO so much tax on your income! That would be like being taxed twice.Go get him! The ATO just love to hear about these sorts of characters and will want to help you.
